The client hereby grants Bre Thurston, LLC and it’s legal representatives and assigns, the right to use and publish photographs of the client or in which the client may be included for editorial, trade, advertising and any other purpose and in any manner and medium. The client hereby releases Bre Thurston Photography and her representatives from all claims and liability related to said photographs. Bre Thurston Photography retains copyright of all images, client's use of images will be limited to personal-use including online sharing and physical prints. Please do not alter or edit your photos without express written permission.
It is understood that wedding/event session deposits are non-refundable, but would be transferable in the event of client or photographer illness/emergency as well as inclement weather. The remaining balance is due 14 days prior to the event date. No images will be delivered until payment is made in full.
Although all care will be taken with the images taken at the event, photographer limits any liability for loss, damage or failure to deliver pictures, for any reason, to return of all photographers fees paid.
Although back-up equipment for all essential items is carried, the photographers are not liable for damages, including but not limited to delay or omission arising from inherent equipment defects or fault, or other causes beyond its control. Liability in any event is limited to refund of all photographers fees paid.
The Photographer may substitute another photographer to take photographs in the event of Photographer's illness or emergency. In the event of such substitution, Photographer warrants that the photographer taking photographs shall be a competent professional. Client reserves the right to deny the use of substitute photographer and, in the event of this denial, will be refunded full photography fees paid.
All disputes arising under this Agreement shall be submitted to binding arbitration before one year from the event date and the arbitration award may be entered for judgment in any court having jurisdiction thereof. Notwithstanding the foregoing, either party may refuse to arbitrate when the dispute is for a sum less than $200.00.
